Arrest made in deadly shooting near East 26th and Ivory

LUBBOCK, Texas (KCBD) - Lubbock police have made an arrest in connection with a deadly shooting in East Lubbock Saturday night.

67-year-old Burns Phenix, Jr. is charged with tampering or fabricating evidence with intent to impair in connection to the shooting.

The shooting left one person dead and two others injured. The initial call of shots fired came in around 7:30 p.m. from the 2600 block of Ivory Avenue.

Police found 49-year-old Levone Madden and 63-year-old Martha Maden, both with gunshot wounds. Levone Madden had serious injuries, and Martha Maden sustained moderate injuries. Both were taken to UMC, where Levone Madden was later pronounced deceased.

Police investigators say, “Madden and 67-year-old Burns Phenix had been socializing in East Lubbock all day. Around 7:30 p.m., the two began arguing in the 2600 block of Ivory Avenue. The argument escalated into a civil disturbance, and both produced firearms with multiple shots being fired. Maden was struck as shots were exchanged. Phenix left the scene before officers arrived.”

Phenix was arrested Monday, Sept. 18 and has since been bonded out of the Lubbock County Detention Center. He was held on a $10,000 bond.

As detectives were conducting the investigation, Phenix arrived at UMC, via private vehicle, with a gunshot wound. He was treated for moderate injuries.
